
The case of Owens -v- Owens (2017) is causing some debate. Mrs Owens is the wife who brought her Petition for unreasonable behaviour against her husband. The husband contested the proceedings. The Court found at first instance that that the husband had not behaved in such a way that the wife could not reasonably be expected to continue to live with him. The Court dismissed the Petition and the wife appealed to the Court of Appeal, who upheld the decision. It begs the question, whether the current law is “fit for purpose”. The matter will now proceed to the Supreme Court for a decision.
