
When it comes to Divorce you also need to be considering your financial matters including your matrimonial assets. It is not only the final financial order that is important, whether this is by Consent or (within proceedings) by the Court’s Order, but also your disclosure.
It is absolutely vital that parties communicate their financial position by disclosing fully and frankly. If one or other party fails to do so you could be in for an unpleasant surprise later. There are three areas where a husband or wife may fail to fully disclosure their assets, fraudulent non-disclosure, inadvertent non-disclosure and catching a party in the act of non-disclosure.
If you are considering going down the route of Divorce, then make sure you deal with the financial matters. Non-disclosure can lead to a variation of Final Financial Order. A party cannot seek to avoid disclosure of material matters by settling at an early stage.
